At Candy Goddess, we are committed to protecting your privacy. This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from our Site.

1. PERSONAL INFORMATION WE COLLECT

We implement industry-standard safeguards to protect your personal information.

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including:

  • Order Information: Name, billing address, shipping address, payment information (processed securely via Shopify Payments), email address, and phone number.

  • Customization Data: Preferences and selections made via the Easy Bundle Builder app to fulfill your custom orders.

  • Marketing Data: Email address and engagement data provided when you opt-in to our newsletter via Klaviyo.

2. HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).

Additionally, we use this information to:

  • Communicate with you: Including order updates and customer service.

  • Marketing (Klaviyo): If you have provided explicit consent, we send you marketing communications and newsletters. You can opt-out at any time using the "Unsubscribe" link in our emails, in compliance with CASL (Canada Anti-Spam Legislation).

  • Optimization: We use Shopify’s native analytics to screen our orders for potential risk or fraud and to improve and optimize our Site.

  • Social Integration (Instafeed): To display User Generated Content (UGC) that you have tagged with our branded handles, as outlined in our Terms of Service.

3. SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above.

  • Shopify: We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.

  • Klaviyo: We use Klaviyo for our email marketing efforts. Your data is stored securely on their platform to manage our communications with you.

  • Compliance: Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful requests for information we receive, or to otherwise protect our rights.

  • Some of these platforms may transfer to and store information in countries outside of Canada where data protection laws may differ.

4. YOUR RIGHTS

A. CANADIAN RESIDENTS (PIPEDA)

If you are a Canadian resident, you have the right to access the personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact our Privacy Officer through the contact information below.

B. CALIFORNIA RESIDENTS (CCPA/CPRA)

If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the 'Right to Know'), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. You also have the right to designate an authorized agent to submit these requests on your behalf.

5. DATA RETENTION

When you place an order through the Site, we retain order data for as long as necessary to comply with legal, tax, and accounting obligations.

Our Site is not intended for individuals under the age of majority and we do not knowingly collect personal information from minors.

6. COOKIES

We use cookies and similar technologies for site functionality, analytics, and marketing. You may manage cookie preferences through your browser settings.

7. CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
