Welcome to Candy Goddess. These Terms and Conditions ("Terms") govern your use of our website (the "Site") and the purchase of any products. The Site is operated by Candy Goddess, based in Ontario, Canada.

By accessing our Site and placing an order, you agree to be bound by these Terms, including those additional terms and conditions and policies referenced herein.

Please review our Privacy Policy to understand how we collect, use, and protect your information.

1. ELIGIBILITY AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your province or state of residence. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

2. ORDER PROCESS AND CONTRACT FORMATION

  • Order Acceptance: Your receipt of an order confirmation (electronic or otherwise) does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.

  • Conclusion of Contract: The contract of sale between Candy Goddess and the customer is considered concluded only upon the dispatch of the Shipping Confirmation Email.

  • Order Cancellations: In rare cases, we may need to cancel an order due to availability or pricing errors. If this occurs, we will contact you promptly with options.

3. PRICING AND PAYMENTS

  • Currency: All transactions are processed via Shopify Payments. Prices may be displayed in CAD or USD.

  • Exchange Rates: The final price charged is the amount shown at the checkout. Candy Goddess is not responsible for minor discrepancies in the final converted amount due to exchange rate fluctuations applied by your financial institution.

  • Taxes: Taxes (GST/HST for Canada and applicable Sales Taxes for USA) are calculated at checkout based on the shipping destination.

4. FOOD PRODUCTS, ALLERGENS, AND SAFETY

  • Product Information: We strive to provide accurate descriptions of our candies. However, nutritional information and ingredients are provided by original manufacturers. Candy Goddess does not represent or warrant that nutrition, ingredient, allergen, and other product information is accurate or complete since this information comes from manufacturers. Manufacturers may improve or change formulas and update labels.  Do not rely solely on website information — contact a healthcare professional if you have specific concerns. 

  • Allergen Warning: Products may be manufactured in facilities that handle nuts, soy, dairy, and gluten. It is the customer's responsibility to review ingredient lists before consumption.  

  • Proposition 65 (California Residents): California residents: Proposition 65 warning may apply to certain products.

  • Packaging:  All of our employees handle our products with extreme care. Our employees always wear masks, hairnets and gloves while handling the candy and while preparing all products. 

5. NO-RETURN AND REFUND POLICY (FOOD SAFETY COMPLIANCE)

Due to the nature of our products and strict health and safety regulations (CFIA and FDA compliance):

  • Final Sale: All food items are Final Sale. To maintain the integrity of our food safety chain, we cannot accept returns or exchanges once the product has left our facility.

  • Bundle Builder Policy: Bundles created via the "Pick & Mix" are considered a single unit. We do not accept partial returns or provide partial refunds for individual components of a bundle.

  • Damages: If your order arrives damaged, you must contact us within 24 hours of delivery with photographic evidence. We will, at our discretion, issue a replacement or a refund.

6. SHIPPING AND DELIVERY

  • Transfer of Risk: Responsibility and risk of loss for the products pass to the customer upon physical delivery to the specified shipping address.

  • Importer of Record (USA): Customers ordering for delivery to the United States are considered the "Importer of Record" and must comply with all local regulations. Any additional customs duties or brokerage fees are the sole responsibility of the customer.

7. USER GENERATED CONTENT (INSTAFEED)

By tagging @CandyGoddess or using our branded hashtags on social platforms, you grant Candy Goddess a non-exclusive, royalty-free, perpetual, and worldwide license to display, use, and modify your content on our Site (via Instafeed) and marketing materials.

8. LIMITATION OF LIABILITY

Candy Goddess shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or site. Our total liability shall not exceed the amount paid by you for the specific product giving rise to the claim.

9. MANDATORY ARBITRATION AND CLASS ACTION WAIVER (FOR U.S. CUSTOMERS)

  • Arbitration: Any dispute arising out of or relating to these Terms or the purchase of products shall be settled by binding individual arbitration in the Province of Ontario, Canada, or through mutually agreed-upon online arbitration.

  • Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to pursue claims as part of a class or representative action.

10. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada.
